한국의 대북한 인도적 개입에 대한 연구

Abstract

인도적 개입은 인권구제에 관한 개념으로서, 일반적으로 타국에서 발생한 심각한 인권참상을 해결하기 위해 한 국가나 여러 국가, 그리고 국가간 기구 등이 무력적으로 개입하는 것을 의미한다.

본 논문은 특별히 북한의 심각한 인권실태에 주목하고, 이것이 자칫 대북 인도적 개입의 필요를 불러일으킬 수 있다는 가정 하에, 한국 정부가 개입자로서 기능할 수 있는 정당성을 살펴보았다. 이에 대한 근거는 첫째, 한국이 북한과의 민족공동체성을 공유하고 있고, 둘째, 현재까지의 대북지원의 역사가 증명하듯 한국은 북한인권에 대한 진정성을 지니고 있으며, 셋째, 한국정부가 물리적 충돌을 감안하면서까지 탈북자 보호에 힘쓰고 있는데, 이는 이미 인도적 개입의 성격을 띤 것으로 볼 수 있기 때문이다. 또한 향후 남북관계의 변화, 납북자․국군포로의 인권, 한국의 탈북주민 수용이 초래하는 북한주민의 연좌제 처벌을 고려할 때, 우리정부의 보다 적극적인 행동은 당위성을 지닌다.

본 논문은 또한 한국이 국제사회에서 북한의 인권위기를 바라보는 동일한 시각을 형성하고, 인도적 개입에 대한 합의된 정의를 도출하며, 대북 인도적 개입에서의 효과적 전략 수립 등에 앞설 것을 제안한다. 이로써 한국의 대북 인도적 개입이 이미 정당성을 획득한 인권개선책일지라도, 국제사회의 공조를 통해 다시 한 번 그 선의의 목적을 입증 받을 수 있도록 하려는 것이다.

인도적 개입은 전쟁을 일으킬 소지가 다분하다는 점에서 논란을 낳을 수밖에 없는 개념이다. 본 논문 역시 이를 충분히 인지하고 있고, 따라서 그것이 인권문제의 유일한 해결책이라고 주장하지도 않는다. 그러나 북한의 심각한 인권상황은 언제라도 인도적 개입이 발생할 수 있다는 위기감을 조성한다. 따라서 본 논문은 어떠한 개입이 가장 정의로울 수 있는지 모색하고자 하였으며, 특별히 한국정부가 주축이 되어 그러한 역할을 수행할 수 있다는 결론을 내렸다. 북한인권에 대한 모든 관심과 연구가 북한주민의 인권개선이라는 실효를 거둘 수 있기를 기대한다.|Humanitarian intervention is a concept of human relief. Generally, it is the use of force by a state, coalition of states, or multinational organizations with the primary purpose of protecting the nationals of the target state from massive violations of human rights.

The purpose of this paper is to explore the legitimacy of a South Korean humanitarian intervention in North Korea. This examination is necessary due to the severity and massive scale of human rights violations in North Korea. The North Korean people are victims of human rights abuses at the hands of their government because it intentionally distorts the meaning of human rights and it wants to maintain its governing system. In particular, South Korea can play a significant leading role in an intervention for the following reasons. First, South and North Korea have the same ethnic identity. Second, South Korea has demonstrated genuine concern for North Korean human rights through its record of aid to North Korea. Third, the act that South Korea protects North Korean defectors who have reached South Korea despite the risk of large-scale provocations can be seen as a form of humanitarian intervention. Moreover, several issues call for bold action by South Korea: upcoming changes in the North-South relationship, the human rights of those kidnapped to North Korea and of prisoners of war, and the punishment given to family members remaining in the North when defectors arrive in South Korea and are given asylum.

South Korea should lead an effort to reach an international agreement on the humanitarian crisis in North Korea and the legitimacy of intervention, and it should take a major role in all stages of the intervention process especially in regards to developing effective strategies. These two steps will justify humanitarian intervention of North Korea by South Korea. Should such situation arise in the future.

Humanitarian intervention is controversial because this doctrine is highly likely to cause conflicts or wars. This paper acknowledges this possibility and does not argue that intervention is the only solution. However, the harsh treatment of North Koreans creates a great need for humanitarian intervention. This paper examines the terms under which a South Korean intervention in North Korea is justified. It is hoped that research on the topic of North Korean human rights including this work will contribute to a real improvement in the lives of North Koreans.
