한국 청소년 성문화의 실태에 관한 윤리학적 탐색 : 청소년 성매매를 중심으로

Abstract

우리 사회는 근래 산업사회와 정보화 사회로 발전해 가는 와중에서 서구식 성 개방, 성해방의 풍조를 받아들여 무질서하고 문란한 성 풍속이 만연되어 가고 있다. 그리하여 전통적인 성의 윤리는 그 개념부터 뿌리째 흔들리고 있다. 다시 말하면 성의 윤리의식이 그 기저에서부터 와해되고 있다고 해도 과언이 아니다. 성의 해방, 성의 개방은 남녀 평등 및 성의 자유를 의미하기도 하지만, 그것이 곧 성의 윤리부재를 뜻하는 것은 결코 아니다. 특히, 우리 사회 성도덕의 문란과 일탈의 심각성을 보여주는 것이 바로 청소년 성매매이다. 청소년 성매매는 주로 어린 여자 청소년들이 성을 팔고 성인 남성들이 성을 산다는 일반적인 성매매 공식과 일치하면서, 특히 여자 청소년의 문제로 대두되고 있다. 최근의 청소년 성매매는 사창가 같은 특정지역을 중심으로 일부 탈선 청소년들에 의해 이루어진다기 보다는 다양한 경로를 통해서 사적(私的)인 매춘으로 변화되고 있다. 청소년들의 이러한 사적 매춘은 기존의 홍등가가 당국의 강력한 제재로 점차 위축되면서 그 영향력을 더욱 넓히고 있다. 청소년 성매매 현상은 청소년에게 신체적·정서적으로 심각한 후유증을 남기고 국가 성 윤리 전반을 파괴하며, 더욱이 청소년들이 미래 우리 사회의 주역이란 점을 상기할 때 우리의 미래사회를 어둡고 암울하게 만드는 요소라고 할 수 있다. 사회 전체의 성도덕·성 윤리가 붕괴되고 있는 현 시점에서 우리는 더 이상, 청소년 성매매가 확산되지 않도록 하기 위해서, 그리고 예방하기 위해서 우리가 무엇을 어떻게 해야 하는지에 대한 물음을 제기해야만 한다. 따라서, 인간의 성이 동물의 성과 비교해 보았을 때 어떤 특징을 지니고 어떠한 가치를 가지며, 그 가치를 실현할 수 있기 위해서 요구되는 규범과 덕목이 무엇인지 살펴봄으로써, 인간의 삶에서 성(性)이란 것이 과연 어떤 위치를 차지하고 있는지 다시 한번 생각해 보아야 한다. 오늘날, 우리 사회에는 성해방의 풍조와 ?? 혁명의 영향으로 성적 자유가 확대되면서 성은 단순히 개인의 사적인 문제로 간주되면서, 성은 더 이상 도덕적·윤리적인 문제가 아니기 때문에 도덕적 규범의 제재를 받을 필요가 없다는 주장까지 제기되고 있다. 그러나, 성이 비록 사적인 문제라고 할지라도, 성은 도덕 해방 지구(morally free zone)에 속할 수 없는 중요한 도덕적 의미를 지니고 있다. 우리가 성적으로 무엇을 원하고, 어떻게 행동하는가 하는 문제는, 어떻게 살 것인가 하는 윤리적 문제와 직결되어 있기 때문이다. 성은 인간의 생물학적 욕구의 표현인 동시에 우리의 인격의 표현이기도 하다. 성의 타락은 가정의 붕괴와 사회질서의 혼란을 초래할 수도 있기 때문에 성적인 문제는 분명히 도덕적 중요성을 가지는 윤리적 문제이다. 따라서, 성은 일정한 규범에 의해 도덕적으로 규제될 필요성이 있으며, 이 점에서 바로 성 윤리의 필요성이 제기된다. 본 연구에서는 기존의 성 윤리 이론들 - 보수주의, 자유주의, 급진주의, 중도주의 -을 종합하여 재구성함으로써 '책임'과 '인간 존중'이라는 두 가지 규범에 의해 우리의 성적 활동이 이루어질 것을 제안한다. 또한, 성매매에 관한 다양한 시각들 - 자유주의적 시각, 마?Ｅ㈌봐聆퓽? 시각, 급진적 여성해방론, 사회생물학적 시각, 기능주의적 시각 -을 살펴보고, 성매매가 과연 윤리·도덕적으로 정당화될 수 있는 가능성이 있는지 검토해보고자 한다. 일반적으로 성매매는 결혼이나 출산과 연결되지 않는 성적 활동이며, 사랑과 친밀감에 기초하지도 않았으며, 인간의 성이 상품화되어 거래되는 것은 바람직하지 않으며, 비인권적인 상황에 의해 '강요된 선택'으로 행해졌다는 점에서 비도덕적이며, 윤리적 정당성을 찾을 수 없다고 본다. 더욱이, 인간을 단지 특정한 목적을 위한 수단적 존재로 간주했다는 점에서 윤리적으로 비난받아 마땅한 것으로 본다. 특히, 청소년 성매매는 협박과 같은 직접적 강제가 작용하지는 않지만, 가치 판단력이 부족한 청소년들에게 경제적 원조나 선물의 제공과 같은 '매력적인 제의'를 함으로써 거절할 수 없게 만들어 성관계를 갖는다는 점에서 도덕적으로 허용될 수 없는 일이라는 것을 강조하고자 한다. 그것은 일종의 '동의에 의한 착취'이다. 비록 청소년 성매매에 대해 아무런 강제 없이 청소년들의 자발적 동의가 있었다고 할지라도, 매력적인 제의에 현혹되어 내려진 그와 같은 동의는 '충분한 정보에 근거한 동의'라고 볼 수 없기 때문에, 그러한 동의는 자유의 허울을 쓴 사실상의 강제와 다르지 않은 것이다. 따라서, 청소년 성매매는 하루 빨리 해결되어야 한다. 청소년 성매매 문제해결을 위해서는, 불행한 가정환경이 개선됨으로써 청소년들이 정서적·경제적으로 안정을 찾을 수 있게 해야하며, 모든 청소년들을 위한 다양한 학교 교육이 이루어지고, 생활지도가 개선되어야 한다. 또, 올바른 성문화 정착을 위한 양성평등적 성 의식·성 윤리 교육이 실시되어야 하며, 청소년들의 성매매의 주요 통로가 되는 인터넷에 대한 교육이 보완·개선되어야 하고, 청소년을 위해서 노동시장을 확대하고 보호시설을 증설해야 한다. 그리고, 청소년들의 성이 안전하게 지켜지고 보호될 수 있는 관련 법률을 새롭게 정비하고 강력하게 시행해야 하며, 무엇보다도 중요한 것은 청소년들에 대한 사회의 적극적인 보호와 지도일 것이다. 마지막으로, 청소년들이 성매매의 유혹을 뿌리치고 올바른 성 의식과 성 태도를 갖도록 하기 위해서는 "정확한 성 지식 전달"과 "성 가치관 확립"이라는 성교육의 양대 축을 제대로 다루어 줄 수 있는 성교육이 중요하다는 점을 강조한다. 기존의 성교육이 지니는 비체계성, 성 지식 전달 ?㎲聆? 교육이 문제점임을 지적하고, 새로운 성교육의 방향은 성 윤리교육의 내용이 강조되어야 함을 주장하고자 한다. 우리는 청소년들이 호혜적으로 존중하고, 책임 있고, 아름다운 성을 가꾸어 갈 수 있도록 도와 주고, 사랑과 절제의 덕을 갖추도록 가르쳐야 할 것이다. 앞으로 더 이상 청소년 성매매가 확산되지 않도록 하기 위해서는 청소년 스스로 가치관을 정립해 나가는 것도 중요하지만 그에 앞서 성인들의 의식수준의 변화와 성도덕의 회복이 이루어져야 한다. 청소년들과 성인들의 인식의 전환과, 우리 사회의 왜곡된 성문화의 변화가 병행되어야 하기 때문이다. 그러나, 본 연구에서는 우리 사회 성문화의 변화에 대한 고민이 부족하다는 점을 한계로 지적할 수 있겠다. 또한, 청소년들이 성매매에 유입되는 것을 방지할 수 있는 구체적인 프로그램의 개발과 관련한 논의가 부족하고, 이는 이후에 연구되어야 할 과제로 남겨두고자 한다.|Disordered and corrupted sex morals have become pervasive in our society by accepting western sex morals of opening and freedom as our society develops to industrialized and information society. Therefore, traditional sex morals are shaken from its root, accordingly. It means the consciousness of sex has been fallen from the previous. Freedom of sex means equality of the sexes and opening of sex freedom of sex but it never means the absence of sex. Sex trading the youth is an example of seriousness of disordered and corrupted sex morals in our society. In sex trading the youth, mainly male adults buy young girls' sex, which appears as a juvenile problem. Recent sex trading the youth has been changed to a private trading through diverse routes rather than the one by some erratic youth centered around a specific region like prostitute quarters. This kind of private sex trading becomes growing as the existing prostitute quarters become daunted by the government's strict disciplinary action. Sex trading of the youth shake the nation's sex morals and destroy the youth physically and mentally. It darkens the future of our society if considering the fact that the youth are the leader of our society in future. At this moment, there should have some measures to prevent sex trading the youth not to be pervasive. Therefore, what status the sex is positioned in human lives would be thought by comparing sexes of human and animal to find out characteristics and virtues, and examining regulations and virtues to be realized. There have been some opinions that the sex doesn't need to be ethically controlled because it's not an ethical and moral problem anymore as it's considered a private matter by expanding sexual freedom influenced by a trend of freedom and revolution of sex. However, sex has an important ethical meaning, can not be indluded in morally free zone, even though it's a private matter. What to sexually want, how to act and how to live are all related to ethical matters. Sex is an expression of human's biological desires and, at the same time, an expression of human's personality. The corruption of sex can bring collapse of family and chaos of social order and so it's an ethical matter to have moral importance. Therefore, sex needs to be morally controlled by a certain regulation and brings a sex ethics accordingly. In this study, it's proposed that our sexual activities should be made by two morals of responsibility and human respect reviewing the existing theories on ethics, conservatism, radicalism and moderatism. It's also reviewed various views on sex trading - liberal, Maxism, radical feminism, social-biological and functional to find out whether it's ethically and morally justified. Generally, sex trading is a sexual activity, not related to a marriage and a birth, and not grounded on love and closeness. It's not desirable to trade human sex and considered as immoral in view of 'forced choice' under inhuman situation. There is no justification for that and furthermore, it's very natural to be morally blamed in view of considering a human as a tool for a special purpose. Especially in sex trade of the youth, it would like to emphasize that it never be morally accepted because it makes the youth not to refuse an 'attractive propose' by offering economic aids and gifts to them, who are immature to judge values, even though there may be an absence of direct force like threatening. This is kind an 'exploitation by an agreement'. Even though there may be an voluntary agreement on sex trading by the youth without any force, it's not different from an actual force under the name of freedom because such agreement can not be understood as an 'agreement based on enough acknowledge'. Therefore, sex trading of the youth should be quickly resolved. To resolve sex trading of the youth, there should be helps to the youth to be emotionally and economically stabled through an improvement of unhappy family situation. There should be also a diverse education and life guidance at school for the youth. It also follows an education on sex consciousness on the equality of the sexes and sex ethics to upright a right sex culture and an internet education to improve its problems and conditions, which is a main route for sex trading of the youth. Labor market and guardianship facilities for the youth are to be expanded. To discipline the youth for protecting their zsex, related law should be re-arranged and strongly enforced, but most of all, active protection and guidance of the society are most needed for the youth. Lastly, the importance of sex education would be emphasized to deliver a 'right sex knowledge' and root a 'right sex view of value' and so for the youth to have a right sex consciousness and attitude to overcome any sex trading by themselves. The existing sex education is quite unsystematic mainly for delivering sex knowledge. The youth should be helped to be educated mutually respected, responsible and to have a beautiful sex consciousness. It's very important to change adults' consciousness on sex and to recover their sex ethics prior to uprighting the youth's view of value to prevent the pervasion of sex trading. To change the distorted sex culture in our society, there should be a change of both adults' and youth's consciousness on sex. However, in this study, there is a limit of insufficient consideration on a change of sex culture in our society. There's also an absence of specific programs and discussions to develop those programs to prevent the youth to engage in the trading and it will be left for further discussions.
