스포츠 영역에서의 쟁점과 유형에 따른 윤리적 접근

Abstract

본 연구는 스포츠에서 발생하는 비윤리적인 문제를 파악하고 응용윤리에서 논의되고 있는 원칙들을 토대로 스포츠윤리 원칙을 구안하여 문제 해결 방안을 모색하는 데 목적이 있다. 즉, 스포츠 영역에서의 쟁점과 유형에 따른 윤리적 접근을 통해 이론윤리학과 응용윤리의 원칙을 바탕으로 스포츠의 특성을 반영한 스포츠윤리 원칙을 구안한다. 그리고 이러한 기준에 따라 유형별 대표적 사례와 이에 대한 다양한 관점의 해석을 위해 구조적 인식의 틀을 제시하였다. 이러한 결과를 통해 선택과 판단의 갈림길에서 도덕적 결정을 내려야 하는 딜레마 상황 속에 윤리적 문제에 대한 의사결정의 결과가 스포츠 영역에서 ‘정의(正義)’의 개념에 부합할 수 있는 기초자료가 되리라 판단된다. 이에 대한 연구결과를 요약하면 다음과 같다.

첫째, 이론윤리학의 한계와 응용윤리로서 스포츠윤리의 적용가능성에 대해 고찰하였다. 스포츠윤리는 응용윤리에 한 분야이지만 지금까지 인식이 부족하였다. 향후 스포츠윤리 관련 연구에서는 응용윤리로서의 스포츠윤리를 바라보고 다양하게 나타나는 윤리적 문제와 그에 대한 해결방안을 모색하는 실천윤리의 성격에 주안점을 두는 연구가 이루어져야 한다.

둘째, 스포츠 영역에서 발생하는 윤리적 문제와 이론윤리학과의 간극인 스포츠 현장의 윤리적 공백에 대해 파악하였다. 이를 위해, 빅데이터 분석 솔루션 텍스톰(TAXTOM)을 이용하였다. 분석결과, 스포츠 영역에서 발생되는 윤리적 문제는 ‘다양하고 복잡하다’는 것을 알 수 있었다. 또한 개인의 문제와 관계 간의 문제를 확인할 수 있었으며, 개인의 문제로 발생 되는 유형과 관계 간에서 나타날 수 있는 문제유형은 다소 차이를 나타냈다. 특히 관계 간에서는 행위주체자가 누구인지에 따라서도 문제유형 역시 다름을 확인할 수 있었다.

셋째, 이론윤리학적 지식과 메타윤리학적 지식을 응용한 응용(실천)윤리의 원칙에 근거하여 스포츠윤리 원칙을 구안하였다. 윤리학에서 다루고 있는 윤리원칙을 근거하여 스포츠 특성을 반영한 스포츠윤리 원칙을 구안하였다. 스포츠윤리 원칙은 배려의 원칙, 무관용의 원칙, 정의의 원칙, 책임의 원칙, 전문성의 원칙으로, 스포츠의 특성인 스포츠맨십, 페어플레이, 공정성 등을 반영하였다. 윤리 문제에 있어 판단기준을 설정하기 위해서 하나의 시도로서 다른 스포츠관련 연구와 차별성을 가지고 있다. 설정한 원칙이 정답은 아니지만 스포츠윤리에 있어 판단기준에 대한 필요성을 제기한 연구들에 대한 하나의 응답이라 할 수 있다. 향후 이 연구를 발판으로 스포츠윤리 원칙이 수정ㆍ보완되어 완성되길 기대하는 바이다.

넷째, 구조적 인식의 틀을 이용하여 문제에 대해 다양한 관점에서 해석을 시도하였다. 스포츠계에서 발생하는 문제를 설정한 스포츠윤리 원칙의 기준에 따라 유형별 대표적 사례와 그에 대한 다양한 관점의 해석을 구조적 인식의 틀에 의해 분석하였다. 구조적 인식의 틀을 이용한 사례분석은 사례를 바탕으로 문제에 대한 접근방법을 쉽게 다가갈 수 있도록 하는 것이며, 다양한 관점에서 해석을 시도하기 위한 기초작업이다. 향후 이러한 지속성을 띤 연구를 토대로 하나의 「스포츠윤리 사례집」이 제공된다면 문제 발생 시 문제에 대한 접근방법과 해결방안을 위한 자료로 활용될 수 있을 것이다. 다섯째, ‘옳고 그름’에 대한 공통적인 도덕적 판단을 기초로 스포츠계 현실의 문제를 해결하기 위한 실천적 해결방안을 제시하였다. 실천적 해결방안에 있어 제도적 측면에서는 ①상벌 규정 내용의 세분화와 기준을 강화해야 한다. ②관련 기관(구단, 협회)에 대해 윤리적 문제 발생 시 책임을 물을 수 있는 제도적 기준을 마련해야 한다. ③스포츠 구성원에 대한 통합관리시스템을 도입해야 한다. ④스포츠윤리 교육을 의무교육으로 제도화해야 한다. 교육적 측면에서는 ①기본적 윤리의식 강화교육을 해야 한다. ②윤리교육 주제 확대와 대상에 따른 유형별 세분화 윤리교육을 강화해야 한다. ③도덕과 교과에서 ‘스포츠윤리’ 분야를 재도입해야 한다.

우리는 스포츠 영역에서 발생하는 다양한 문제들을 접할 때 먼저 법적, 제도적 측면에서 문제를 생각하게 된다. 하지만 다양한 윤리적 관점에서 문제를 바라보며, 기본적인 문제점을 인식하고 변화가 되어야 되풀이되는 문제들이 해결되지 않을까? 사람이 변해야 사회가 변할 수 있듯이 스포츠에 참여하는 모든 사람의 윤리의식이 올바르게 변해야 스포츠에서 발생하는 윤리적인 문제가 줄어들고 스포츠의 가치가 상승하지 않을까 사료 된다. 스포츠계는 당대의 삶과 사회를 반영하는 ‘사회적 축소판’으로서 스포츠가 지닌 도덕적 가치를 배울 수 있는 효과적인 수단이다. 스포츠윤리의 궁극적인 목표인 ‘정정당당함’, ‘공정성’, ‘정의’와 ‘용기’ 등을 자신 스스로가 지켜내는 끊임없는 노력이 계속될 때 스포츠가 우리의 삶에서 가치 있는 문화로 존립하게 될 것이다. 아울러 스포츠계를 생태계로 표현하자면, 스포츠 안에 구성원들은 복잡한 먹이사슬처럼 얽혀 있다. 이 중 누구 한 명이라도 빠지게 되면 무너지게 되는데 이를 방지하기 위해서는 서로를 존중하고 배려하는 마음으로 그 중심에 ‘스포츠맨십’이 있다. 즉, 스포츠라는 공동체 안에서 서로를 존중하고 배려하게 되면 자연스럽게 윤리적 문제는 발생 빈도가 낮아질 것이고, 이것이 바로 ‘실천윤리’라고 볼 수 있을 것이다. |The purpose of this study is to identify unethical problems arising from sports and analyze specific cases through sports ethics principles to find ways to solve problems. In other words, through ethical approaches based on issues and types in the field of sports, we devise sports ethics principles that reflect the characteristics of sports based on the principles of theoretical ethics and applied ethics. In addition, this criterion presents a framework for structural recognition for interpretation of representative examples by type and from various perspectives. These results will serve as a basis for decision-making on ethical issues to conform to the concept of “justice” in the sports sector amid a dilemma in which moral decisions must be made at a crossroads between choice and judgment. In summary, the findings are as follows.

First, we consider the limitations of theoretical ethics and the applicability of sports ethics as applied ethics. Sports ethics is a field of applied ethics, but so far there has been a lack of awareness. In future research on sports ethics, research should focus on the nature of practical ethics that looks at sports ethics as applied ethics and seeks solutions to various ethical problems.

Second, we identify ethical issues arising in the field of sports and ethical gaps in the field of sports, a gap between theoretical ethics. To this end, we utilize a big data analysis solution called TEXTOM. Analysis shows that ethical issues arising in the field of sports are ‘diverse and complex’. We can also consider the problems between individual problems and relationships, and the types of problems that arise from individual problems and the types of problems that can arise between relationships are slightly different. In particular, the type of problem could be seen slightly different depending on who the agent was.

Third, we devise sports ethics principles based on the principles of applied (practical) ethics that apply theoretical and meta-ethics knowledge. Based on the ethics principles covered in ethics, we devise sports ethics principles that reflect sports characteristics. The principles of sports ethics reflect the characteristics of sports such as consideration, zero tolerance, justice, responsibility, and professionalism. In order to establish standards of judgment in ethical matters, it is differentiated from other sports-related research as an attempt. Although the principle set is not the answer, it is a response to studies that have raised the need for judgment standards in sports ethics. It is hoped that the principles of sports ethics will be revised and supplemented based on this research in the future.

Fourth, we attempt to interpret the problem from various perspectives using the framework of structural recognition. In accordance with the criteria for sports ethics principles that set out problems arising in the sports world, representative examples of different types and interpretations of them from different perspectives were analyzed by structural recognition framework. Case analysis using the framework of structural recognition makes it easier to approach an approach to a problem based on examples, and is a basic task to attempt interpretation from various perspectives. If a 「sports ethics casebook」 is provided based on such sustainable research in the future, it can be used as a data for approach and solution to problems in case of problems.

Fifth, we present practical solutions to solve the problem of sports reality based on common moral judgments about ‘right and wrong’. Institutional aspects of practical solutions, ①The details and standards of the content of the punishment and punishment regulations shall be strengthened. ②Institutional standards should be established to hold relevant institutions (clubs, associations) accountable in the event of ethical problems. ③An integrated management system for sports members shall be introduced. ④Sports ethics education should be institutionalized as compulsory education. In terms of education, ①Education to strengthen basic ethical awareness should be provided. ②Ethical education shall be strengthened by expanding topics of ethical education and by classification by subject. ③The field of ‘sports ethics' should be reintroduced in ethics and curriculum.

When we encounter a variety of problems that arise in the field of sport, we first think of them in terms of legal and institutional terms. However, looking at the problem from various ethical perspectives, will it not be solved if we recognize the basic problem and change it? Just as society can change only when people change, it is believed that the ethical awareness of everyone participating in sports must change properly to reduce ethical problems and increase the value of sports. The sports world is an effective means of learning the moral values of sports as a ‘social miniature’ reflecting the lives and society of the time. Sports will exist as a valuable culture in our lives when constant efforts to protect ourselves, such as ‘fair and square’, ‘fairness’, ‘justice and courage’, which are the ultimate goals of sports ethics, continue. And the sports system can be described as an ecosystem. Members in the sport are connected in relation to each other, as is the food chain. If any of them is left out, it will collapse, and in order to prevent this, ‘sportsmanship’ is at the center of it with respect and consideration for each other. In other words, respecting and caring for each other in a community called sports will naturally reduce the frequency of ethical problems, which can be seen as 'practice ethics'.
