사회과 교실의 청소년 법정 수업모형 개발

Abstract

사회과교육에서 법교육은 민주시민교육의 핵심적 영역으로 법률 전문가를 길러내는 법학교육과 달리 청소년 및 일반 시민의 법의식 함양을 목표로 한다는 점에서 차이가 있다. 이 연구는 법교육의 의미 있는 프로그램인 미국의 청소년 법정제도를 문헌을 통해 고찰하고, 이를 기반으로 법교육의 목표인 법의식 신장을 위하여 우리나라 사회과 교실에 적합한 청소년 법정 수업모형을 개발한 것이다. 본 수업모형은 교사가 만든 시나리오를 그대로 적용한 기존 모의재판과 달리 청소년들의 구체적인 경험을 법정의 출발점으로 함으로써 학생들이 흥미를 갖고 수업에 참여하여 법교육의 최종 목표인 법의식 신장에 기여할 수 있도록 설계하였다. 연구 결과, 첫째, 청소년 법정제도 수업모형을 통한 법교육은 강의식 수업보다 법적 절차, 법의 기능, 법의 역할 등 법 관련 지식을 풍부하게 획득하게 될 것으로 판단된다. 둘째, 사회과 수업과정에서 재현된 재판과정은 어렵고 딱딱했던 법이라는 이미지를 탈피하여 법적 신뢰감을 형성해 주고, 나아가 민주시민으로서 법의식 함양에 이바지 하게 될 것이다. 셋째, 사례를 통해 법적 해결과정을 경험한 학생들은 자신들의 당면한 법적 문제를 이해하는 데 도움이 될 것으로 기대된다.

Consequently, through this study, first, the substantially legal knowledge is allowed to be acquired in order to solve the legal problem. And, the acquired knowledge comes to be learnt with the demonstration of a teaching model in the Teen Court. Thus, the law-related knowledge comes to be acquired such as the legal procedure, legal function, and legal role more than the lecture-styled teaching. Second, through a trial that had failed to be experienced in the existing school teaching, the students can have confidence in the law by escaping from the image dubbed the difficult and strict law, and further come to devote themselves to promoting the legal consciousness as a democratic citizen. Third, students, who experienced the legally-solving process through a case, may expect to be helpful in understanding their facing legal problem.
